'인디언' 같은 해묵은 용어가 포함되어 사문화된 조항이라 오해할 수 있으나, 미국 헌법사에서 연방과 주의 관계를 정의하는 데 큰 영향을 미친 조항이다. 2개 이상 복수 주의 경제적 이해관계가 미치는 상거래가 발생할 경우 연방 의회가 간섭할 수 있게 함으로써 기업 활동은 물론 고용, 노동, 의료, 행정, 교육, 문화 등 사회 각 분야에서 연방법이 주법보다 우위에 설 수 있게 된 것이다. 특히 대공황 이후 연방 의회는 경제활동을 광범위하게 해석하여 많은 규제법을 제정하였다가, 다시 1990년대부터는 법원이 적극적인 세력 균형에 나서는 형국이다.[* 예를 들어, 미합중국 대 로페즈(United States v.
